Acceptance of Terms

By accessing or using this website (the “Site”) and any related early‑access software, services, or communications provided by Frozen River Software (“we”, “us”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.

Use of the Site

Use the Site lawfully and respectfully. Do not attempt to disrupt, probe, or reverse‑engineer the service.
You may not use the Site to transmit malicious code, spam, or infringing content.

Early Access / Pilot / Beta

Some features may be offered as pilot, preview, or beta. They are provided for evaluation only and may change or end at any time.
Beta features may be incomplete, contain bugs, and are provided “as is” without warranties (see Warranties & Liability).

Intellectual Property

The Site, software, and content (excluding user‑provided content) are owned by us and protected by applicable IP laws.
You may not copy, modify, or redistribute the Site or software unless we provide written permission.

Feedback

If you choose to share suggestions or feedback, you grant us a non‑exclusive, irrevocable, worldwide, royalty‑free license to use it without restriction.

Third‑Party Services

We use third‑party providers (e.g., hosting/CDN, email newsletter). Their services are subject to their own terms and privacy practices.

Warranties & Disclaimers

THE SITE AND ANY EARLY‑ACCESS FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error‑free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY EARLY‑ACCESS FEATURES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability for any claim shall not exceed one hundred (100) CAD.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or infringement of third‑party rights.

Termination

We may suspend or terminate access to the Site or early‑access features at any time, with or without notice, for any reason including suspected misuse or legal compliance.

Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Alberta, Canada, for any disputes arising out of these Terms.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will reflect the current version. Your continued use of the Site after changes become effective constitutes acceptance.
